Terms and Conditions

This is the English translation of the Portuguese Termos e Condições. If the two versions differ, the Portuguese version prevails.

1. Service and provider

The doutorai.pt website and the Doutor AI service are provided by Miguel Diamond, a sole trader (empresário em nome individual), tax identification number (NIF) 245528598, with professional address at Avenida da República 2470, Vila Nova de Gaia, Portugal (email info@doutorai.pt).

Doutor AI provides access to a library of AI prompts and resources: tools by industry, prompts, How-to guides, AI apps, a technical library and an AI assistant (Dr AI). The prompts are support tools: the results depend on the third-party AI you use.

2. Acceptance, version and language

You accept these Terms when you create an account and with each purchase, in the version in force at that time. The version and the date are at the top of this page. You can save or print this page (there is also a plain-text version at doutorai.pt/en/terms.md), and the confirmation email for each purchase includes links to these Terms and to the Refund Policy.

The contract is concluded in Portuguese. If we publish these Terms in another language, the Portuguese version prevails in the event of any discrepancy.

3. Account

You can create a free account from the age of 16. To buy the Pro plan or credit packs you must be at least 18.

The account is personal: use a valid email address and keep your password secret and, if you turn on two-step verification, its codes. If you sign in with Google, we create the account or link it to the one you already have with the same verified email.

We may suspend the assistant or the account in the event of abusive use (section 9) or a disputed payment (section 5). You can close your account whenever you want: ask for it to be deleted by email to info@doutorai.pt.

4. Free plan and Pro plan

The free plan lets you explore the whole library, see the prompts in preview and use the AI assistant with 1,500 credits per month. The Pro plan includes every complete prompt (PT and EN), the complete technical library, Saved items (saving prompts and other content to come back to them), the Dr AI assistant personalized for your business and 5,000 AI credits per month.

The monthly Pro plan costs €7.99 per month and renews automatically every month until you cancel it. The annual Pro plan costs €39.95, is a one-off payment and gives 12 months of access, with no automatic renewal. Prices include applicable taxes. The VAT rate is the standard statutory rate of 23%.

The plan's AI credits renew on the 1st of each month (UTC time); credits you do not use do not carry over to the following month.

You can cancel the monthly subscription at any time, with no minimum term: in your account, under "Manage subscription", or by email to info@doutorai.pt. Access continues until the end of the period already paid, with no future charges.

If we change the price of the monthly Pro plan, we will let you know by email at least 30 days before the renewal to which the new price applies, and you can cancel before that date.

5. Payments and invoicing

Payments are processed securely by Stripe. Card works on every plan; MB WAY and Multibanco work on the annual Pro plan and the credit packs, not on the monthly Pro plan, which is a subscription. We do not store your card details. Some payments are not confirmed immediately, such as a Multibanco reference: in those cases, Pro access or the credits become active when Stripe confirms the payment.

For each payment, our system issues a combined invoice and receipt (fatura-recibo) directly in Moloni, invoicing software certified by the Portuguese Tax Authority, which sends it to you by email. The receipt Stripe sends is not the invoice. If you want the invoice with your tax number (NIF), enter it on the payment page.

When we refund a payment, what that payment bought comes to an end: Pro access or the unused credits of the pack. If you dispute a payment with your bank, we suspend what that payment bought, and the assistant, while the dispute is ongoing; if it ends without the payment being returned, we restore access.

6. Credit packs

In addition to the monthly credits, you can buy AI credit packs, with a one-off payment and VAT included: Top-up (2,000 credits, €4.95), Pack (6,000 credits, €9.95) and Mega (20,000 credits, €24.95). One credit corresponds to 200 tokens (the units of text the AI model processes); each answer from the assistant uses credits according to the length of the question and of the answer.

Purchased credits are used after the monthly credits and are valid for 12 months from the purchase; between packs, the ones that expire first are used first. Credits you do not use within that period are no longer available.

Credits are personal and non-transferable and have no cash value: they cannot be exchanged for money, except for the refund provided for in the Refund Policy.

Credits are added to your account when the payment is confirmed. Before paying, you confirm that you want to receive them immediately and that, with this immediate delivery, you lose the 14-day right of withdrawal (section 7).

7. Right of withdrawal and refunds

As a consumer, you have 14 days from the purchase to withdraw from the contract without giving any reason. To do so, send us an unequivocal statement, for example by email to info@doutorai.pt; you can use the form at the end of the Refund Policy, but it is not mandatory.

Pro plan: access starts right after payment, with your consent, and even so we refund the full amount if you ask within 14 days of the purchase.

Credit packs: with the consent you give before paying for immediate delivery, the statutory right of withdrawal no longer applies (Decree-Law No. 24/2014, Article 17(1)(l)). Even so, on request, we refund the credits not yet used up to 14 days after the purchase.

The full rules are in the Refund Policy, which is more favorable than the law requires.

8. AI assistant (Dr AI)

Dr AI is an artificial intelligence assistant. Its answers are generated automatically by an Anthropic Claude AI model, based on your messages, the business profile you fill in and the prompt you are viewing. This data is sent to Anthropic, which generates each answer on our behalf.

Answers may be wrong, incomplete or out of date and do not replace legal, medical, financial or tax advice: check them before you decide. Do not send other people's personal data, confidential information or illegal content.

The assistant has daily message limits and uses the AI credits of your plan and of the packs you buy (sections 4 and 6). We may limit or suspend the assistant in the event of abusive use.

9. Acceptable use

You may not resell or redistribute the subscription content. Exception: third-party content under an open license (for example CC BY 4.0, MIT or Apache 2.0), identified on its own page, may be reused under the terms of that license. You also may not extract content by automated means, get around paid access or usage limits, share your account with other people or use the service for illegal purposes.

If you do not follow these rules, we may suspend or close the account, without prejudice to your rights as a consumer.

10. Intellectual property

The brand, the design and the original content of Doutor AI belong to us. So do the translations and adaptations we make. Your subscription gives you a personal, non-exclusive and non-transferable right of use.

You can use the prompts, and the results you get with them, in your own business. What you produce with third-party AI tools is yours, under the terms of those tools.

11. Third-party content and licenses

The open-source technical library keeps the original licenses of its authors, which you must respect. Many components use the MIT license.

The image prompts from the public YouMind OpenLab collections are used under the Creative Commons Attribution 4.0 International license (CC BY 4.0): the page of each one shows the original author, the collection, the license and, where there are any, the changes made.

ChatGPT, Gemini, Claude and the other brands mentioned belong to their respective owners and appear only to identify the tools. If you hold rights over any content and want us to remove it, write to info@doutorai.pt.

12. Availability and changes to the service

We do our best to keep the service available, but there may be interruptions for maintenance or because of third-party failures. We may add, change or remove free features. If a change reduces what the Pro plan or the credit packs include, we will let you know in advance and, if the change is to your detriment, you can terminate the contract under Decree-Law No. 84/2021.

13. Liability

As a consumer, you are entitled to the conformity of the digital service under Decree-Law No. 84/2021, and these Terms do not exclude or limit that right. We are not responsible for decisions made on the basis of the content or of the results of third-party AI, to the extent permitted by law. The same applies to decisions made on the basis of the assistant's answers and to cases of force majeure.

14. Applicable law, complaints and disputes

Portuguese law applies. You can make a complaint by email to info@doutorai.pt or in the electronic Complaints Book (Livro de Reclamações Eletrónico, livroreclamacoes.pt).

In the event of a consumer dispute, you can turn to one of the competent alternative consumer dispute resolution entities, such as the consumer arbitration centers. The official list is on the Consumer Portal (www.consumidor.gov.pt). In consumer disputes of up to 5,000 euros, if you choose a consumer arbitration center, arbitration is mandatory for us (Law No. 63/2019).

In consumer disputes, the competent court is the one the law determines for consumer protection. In all other cases, the court of the district (comarca) of Porto has jurisdiction.

15. Changes to these Terms and contact

We may update these Terms. The new version will be on this page, with the version and the date. If the change is significant, we will let account holders know by email at least 30 days before it applies to the following renewals, and you can cancel before then.
